Notice of Variation, Section 103 of the 1985 Housing Act

We are writing to inform you that the Council has approved changes to its tenancy agreement. This letter explains what is changing, when the changes will take effect, and what this means for you.

What is changing

The updated tenancy agreement:

  • Meets current legal and regulatory requirements.
  • Uses clearer and more consistent wording to strengthen the rights and responsibilities of both tenants and the Council.
  • Gives a clear understanding of the protections in place to keep you safe and secure in your home, as well as the standards you can expect in the management of your tenancy.

The main changes include:

  • Enhanced clarity and structure to improve readability and accessibility for tenants.
  • Clarity on data sharing used for prevention and detection of fraud.
  • Clearer wording on tenant and landlord responsibilities.
  • Updated clauses on anti-social behaviour and domestic abuse.
  • A more flexible approach to responsible pet ownership.

When the change takes effect

The new tenancy agreement will take effect on 1 July 2026, which is not less than four weeks from the date this notice is served.

If you choose to continue your tenancy, you do not need to do anything. If the new agreement does not meet your needs, you can choose to end your tenancy by giving 28 days’ notice to your managing agent.

A copy of the new tenancy agreement, together with a Frequently Asked Questions document and Comparison of Changes document, is available to view online at:

Legal notice
This letter constitutes a formal Notice of Variation under Section 103 of the Housing Act 1985.

The Council issued Preliminary Notices of Variation to secure tenants on 1 August 2025 and 13 October 2025 and carried out a consultation in accordance with the requirements of the Act, during which secure tenants were invited to comment on the proposed new tenancy agreement.

During the consultation:
237 tenants took part
161 comments were received 

All feedback was carefully considered and, where appropriate, reflected in the final tenancy agreement.

If you wish to accept the variation and continue your tenancy, you do not need to sign or return anything. This notice will be treated as acceptance of the variation unless you choose to end your tenancy.
